Conditions of sale

DEFINITION AND OBJECT OF THE CONTRACT
The present is a distance contract in the sense of art. 50 and following. Legislative Decree no. 206 of 6 September 2005 (“Consumer Code”). The purpose of the Contract is the sale of movable property between Azienda Agricola Felciano., with registered office in Greve in Chianti, Via Case Sparse, 45, C.F/P.IVA MRLMRZ62M12E169A – IT05170830482, and the Client. The Contract is concluded directly through the acceptance by Azienda Agricola Felciano of a purchase proposal issued by the Client by telephone or through the website www.felciano.it and/or through other distance selling systems.

 

PRICES AND AVAILABILITIES
Product prices include VAT.
Some products may be subject to limited availability, therefore, the acceptance by Azienda Agricola Felciano of the purchase proposal submitted by the Customer is subject to the availability of the products in stock. Azienda Agricola Felciano undertakes to promptly communicate to the customer any unforeseeable out of stock due to excess demand or other causes.
Compagnia Agricola Felciano reserves the right to waive the sale and to communicate this waiver to the customer within 10 days of receipt of the order.

 

PRODUCT RECOMMENDATIONS – CLAIMS
Azienda Agricola Felciano delivers the products, to the address indicated by the Customer, within 30 (thirty) days from the conclusion of the Contract.
The contract is concluded at the time of payment as indicated.

At the time of delivery the customer must check:

● the integrity of the package and that it is neither damaged nor wet, that it conforms to the normal characteristics of a package.

● the correspondence of the number of packages with those indicated on the letter of the carrier.

● the signature of the delivery documents implies the unreserved acceptance of the goods by the customer.

● Any complaints must be immediately and raised with the carrier; in the absence of these, the product is considered correctly delivered; all documents contained in the package must be kept.

● The complaint of the package must be made first to the courier who made the delivery by calling if available a toll-free number or any other number made available, or to the nearest office. Then send by email the complaint to info@felciano.it with photo, time and day of delivery, file number issued by the courier who made the delivery.

● No complaints will be accepted more than 5 days after receipt of goods.
If the goods, is visibly damaged, (broken packaging, spillage of wine etc.), at the time of delivery by the courier, it is advisable to reject goods.
Azienda Agricola Felciano will send you the products back intact.
In case of delivery of an order of goods through different units, it is sufficient to reject only the package containing the damaged goods and write on the bill “With reserve”.
Azienda Agricola Felciano will replace only the damaged goods.

 

RIGHT OF WITHDRAWAL
The right of withdrawal can be exercised, within the terms provided, by sending a written notice to the following address Azienda Agricola Felciano – 50022 Greve in Chianti (FI), Via Case Sparse, 45
The right of withdrawal can be exercised within 14 working days from receipt of the goods (art. 65 paragraph 2 letter a). The right of withdrawal is respected if Azienda Agricola Felciano has received communication of the Customer’s intentions within this time frame. The communication must be sent by registered letter with return receipt, or e-mail ( info@felciano.it )
The goods received must be returned to the following address: Azienda Agricola Felciano – Via Case Sparse 45, 50022 Greve in Chianti (FI) within a maximum of 15 working days from the date of receipt of the goods).
The shipping costs are charged to the customer.

 

CUSTOMER OBLIGATIONS
The Customer represents and warrants: to be a consumer in accordance with the provisions of art. 3 of the Consumer Code; to be of legal age; that the data provided by the same for the execution of the Contract are correct and truthful.
Purchase contracts entered into by minors.
The purchase can only be made by legal age. However, if the purchase is made by a minor providing false information regarding age, or false information to purchase the desired object and / or to access the desired data, the parents are directly responsible for the payment of the purchase without prejudice to the discipline of withdrawal of these conditions of sale

 

RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the contract stipulated, without penalty and without specifying the reason, within 10 days of receipt of the products.
The Customer may exercise the right of withdrawal, within the above mentioned term, by means of a written communication at the headquarters of Azienda Agricola Felciano, to be sent by registered letter with acknowledgement of receipt or by telegram or e-mail.
The Customer who intends to exercise the right of withdrawal must return the products to the address indicated on the invoice, following the instructions therein, within 15 days of receipt of the products. Pursuant to Article 55, second paragraph, of the Consumer Code, the Customer will not have the right of withdrawal in the following cases:
– supply of products made to measure or personalized, or which by their very nature, cannot be returned or are liable to deteriorate or alter rapidly (eg:, food);
The costs of returning the products are borne by the Customer. Azienda Agricola Felciano will return the products within 30 days from the date of receipt of the products by the Customer: the full price paid by the Customer in case of return of the product intact; or the part of the price equivalent to the product actually returned by the Customer who has consumed it in an appreciable way and/or such as to diminish its value.
The goods must be returned in their original packaging and in packaging suitable to guarantee their integrity during transport.

 

Applicable law
These General Conditions, as well as any contract of sale concluded between the Seller and the Buyer, shall be governed by and construed in accordance with Italian law.

JURISDICTION AND COMPETENT HOLE

For any and all disputes arising from these Terms and Conditions and the contracts of sale concluded on the basis thereof, the exclusive jurisdiction will be the Italian one and the jurisdiction will belong exclusively to the Court of Florence.
